Agroforestry and the eligibility of the Single Farm Payment

Here is an unofficial translation (date: 18 Feb 2013) of the Exceptions Regime under the Single Farm Payment provided by the Gabinete de Planeamento e Políticas (www.gpp.pt) (Portuguese Office for Planning and Policy).

The purpose of this translation is to provide insights of the portuguese transposition of agroforestry EU legislation. In this case, providing some "exceptions to the rule" regarding the possible conflicts with Pillar I subventions, namely the Single Farm Payment.

Areas with Chestnut and Stone pine intended to fruit production (minimum 60 trees/ha). The chestnut and the pine kernel are considered agricultural products in the Annex I of the treaty.

 

In the occurrence of shrubby vegetation , this land class should be considered, as long as the orchard surface presents conditions for the fruit collection.

In the case of abandoned orchard where the shrubs are dominant, the area is classified under “Other surfaces” (point 4.4.2 do of Annex I do Despacho Normativo n.º 4/2012, changing o Despacho Normativo n.º 7/2005). (see links to documents below)

Cork oak woodlands for cork production

Areas with a minimum density of 40 cork oak trees/ha, oriented towards cork production, where the cork oak are responsible for 60% of the cover trees in the parcel. Cork is an agricultural product according to the Annex I of the treaty.

 

In the case of the presence of disperse shrubby vegetation, this class should be considered, as long as the cork oak trees show evidence of cork production exploitation.

In the case of the parcel where cork oak trees are present , but does not present conditions for the cork extraction nor the undercover exploitation, the area should be considered as Forestry (pooint 3.1 of Annex I of Despacho Normativo n.º 4/2012, changing Despacho Normativo n.º 7/2005) .(see links to documents below)

In the case of the parcel where cork oak trees are present , without conditions for the cork extraction but with exploitation of the undercover, this class should be considered as “Quercineae undercover” (point 2.4 do Annex I of Despacho Normativo n.º 4/2012, changing Despacho Normativo n.º 7/2005).(see links to documents below)

Areas with Quercineae 1) where the cork oak is not exploited for cork production, 2) with Holm oak, 3) with Quercus pyrenaica or 4) where mixture of these are responsible for 60% of the tree cover and that presents conditions for the exploitation of the undercover for plant production, namely permanent grassland.

 

 

In the case of shrubby vegetation, this class shall be considered as long as the stand presents conditions for the undercover exploitation.

 

Classification in terms of tree cover:

 

A – Cover <=50%

B – Cover > 50% e <=75%

C - Cover > 75%

Cover A:  90%

Cover B:  70%

Cover C:  0%

 

In the case these stands are not exploited for cork production nor verify conditions for the undercover exploitation for plant production, they shall be classified as Forestry (point 3.1 of annex I of  Despacho Normativo n.º 4/2012, changing Despacho Normativo n.º 7/2005).(see links to documents below)

In the case of a stand where the shrubby vegetation is dominant and do not verify conditions for the undercover exploitation for plant production, they shall be classified as Forestry (point 3.1 of annex I of Despacho Normativo n.º 4/2012, changing Despacho Normativo n.º 7/2005). Under cover of Chestnut or Stone Pine


Areas with Chestnut and Stone pine NOT intended to fruit production but with conditions to exploit the undercover, namely permanent grassland, where the Chestnut or Stone pines are responsible for 60% of the tree cover component.

 

In the case of shrubby vegetation, this classification shall be considered  as long as the stand presents conditions for the undercover exploitation, namely permanent grassland.

 

Classification in terms of tree cover:

A – Cover <=50%

B – Cover > 50% e <=75%

C - Cover > 75%

Cover A:  75%

Cover B:  50%

Cover C:  0%

The stands of these species exploited for the fruit production shall be classified as Orchards (point 1.2.1 of annex I of Despacho Normativo n.º 4/2012, changing Despacho Normativo n.º 7/2005).(see links to documents below)

Areas with shrubby vegetation composed by spontaneous woody vegetation with height greater than 50 cm.

Shrubby vegetation when found in areas higher than 100m2 and that may be delimited, shall be considered as Non Forested Wooded Land (NFWL)

Eligibility determined after the exclusion of the delimited areas.

Dispersed shrubby vegetation that cannot be considered as NFWL, if occupying up to 25% of the parcel, should be considered part of the parcel. The land occupation shall be the dominant.

Dispersed shrubby vegetation that cannot be considered as NFWL, if occupying between 25% and 50% of the parcel, parcel, leads to consider the dominat land use, but an eligibility coefficient shall be applied.

Dispersed shrubby vegetation that cannot be considered as NFWL, if occupying more than 50% of the parcel, should be considered as dominant, being the area classified as NWFL .
